Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the WinIt.space platform and related services (the “Service”), operated by OVRS (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using WinIt, you confirm that you are at least 13 years of age (or the minimum age required in your jurisdiction) and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

WinIt is a task management and team collaboration platform that provides features including but not limited to:

  • Task boards with customizable groups, columns, and views (table, Kanban, gallery, timeline).
  • Workspaces for organizing teams and projects.
  • Collaboration tools including invitations, member management, and shared boards.
  • Time tracking with Pomodoro timer and manual time entries.
  • Standup notes and activity feeds.
  • File attachments and storage.

3. Account Responsibilities

You are responsible for:

  • Maintaining the security and confidentiality of your account credentials.
  • All activities that occur under your account, whether authorized by you or not.
  • Providing accurate, current, and complete information during registration.
  • Promptly notifying us if you suspect unauthorized access to your account.

You may authenticate using email and password or through third-party OAuth providers (Google, GitHub, Discord). When using OAuth, you authorize us to receive the profile information permitted by those providers.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights.
  • Upload malicious files, malware, or content that could harm the Service or other users.
  • Attempt to gain unauthorized access to other users' accounts, data, or workspaces.
  • Circumvent or interfere with security features, including Row Level Security policies.
  • Use automated tools (bots, scrapers, etc.) to access the Service without our written permission.
  • Engage in harassment, abuse, or any conduct that disrupts the experience of other users.
  • Misrepresent your identity or affiliation with any person or organization.

We reserve the right to suspend or terminate accounts that violate these rules, with or without prior notice.

5. User Content

Ownership: You retain all rights to the content you create on WinIt, including tasks, boards, comments, attachments, and other data (“User Content”).

License: By uploading User Content to the Service, you grant us a limited, non-exclusive, worldwide license to store, process, display, and transmit your content solely for the purpose of operating and providing the Service to you and your collaborators.

Responsibility: You are solely responsible for the legality, accuracy, and appropriateness of your User Content. We do not monitor or endorse User Content and are not liable for any content posted by users.

6. Intellectual Property

The Service, including its design, code, logos, trademarks, and documentation, is the property of OVRS and is protected by intellectual property laws. Nothing in these Terms grants you any right to use our brand name, trademarks, or logos without prior written consent.

7. Free Tier & Pricing

WinIt is currently offered as a free service. We reserve the right to introduce paid plans, features, or usage limits in the future. If pricing changes affect your account, we will provide reasonable advance notice. Free-tier usage may be subject to fair-use limits that we may enforce at our discretion.

8. Service Availability

We strive to keep WinIt available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service is provided on an “as is” and “as available” basis. We may perform maintenance, updates, or experience outages that temporarily affect availability. We will make reasonable efforts to notify users of planned downtime.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OVRS AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

Our total aggregate liability for any claims arising from or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months prior to the claim, or (b) one hundred U.S. dollars ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless OVRS and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your User Content, or your violation of these Terms.

12. Termination

You may terminate your account at any time by contacting us or using the account deletion features within the Service. We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms.

Upon termination, your right to use the Service ceases immediately. We will delete your personal data in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination (including Sections 5, 9, 10, 11, and 13) shall continue in effect.

13. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which OVRS is established, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to the exclusive jurisdiction of the courts in that jurisdiction.

14. Modifications to Terms

We may revise these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page and, where appropriate, notify you via email or an in-app notice. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
